HD Guru recently published an article entitled "Is your TV watching you?" In it, we discussed the fact that new features in Samsung's top 2012 models -- including built-in microphones, HDTV camera, wireless and wired Internet connection, built-in browser with voice to text conversion, face recognition and more -- could be used to collect unprecedented personal information, as well as present a new way for hackers to invade users' lives.

We asked Samsung for a privacy statement prior to publication, but the company did not respond. Now, Samsung has given HD Guru an official comment, and shared two separate privacy policies. In the interest of transparency, here's the complete statement, with our emphasis added on key parts:

Samsung takes all concerns regarding consumer privacy and information security very seriously. In all of our Smart TVs, including our new 2012 LED and Plasma TVs featuring built-in camera and microphone components, Samsung employs industry-standard security safeguards and practices (including data encryption) to secure consumers? personal information and prevent its unauthorized collection or use.

Samsung also ensures consumers have the opportunity to review the terms of the company?s Privacy Policy prior to using Samsung?s Smart TV services. The Privacy Policy can be found at?www.samsung.com/privacy. ?

The camera and microphone are integrated into the TV to provide users with innovative new ways to control the TV. They may also be used for video conference and speech-to-text services offered by third parties, in which case the audio and video data is transmitted to the service providers? servers and does not pass through Samsung servers. Images captured in order to use the facial recognition feature are stored in a secure manner on the owner?s TV only.?

Should the TV owner choose not to use these features, the camera and microphone can be disabled. Users can check if the camera and microphone are activated from the TV?s settings menu. As an added precaution, the camera can be rotated and tucked into the bezel of the TV. Once tucked away, the camera only captures a black image.

Samsung is dedicated to instilling consumer confidence in this matter. Any questions regarding the Privacy Policy or protection of personal information on the TV can be directed to intertv@samsung.com.

Samsung says it does not upload video or voice streams into its servers, though it does sample your voice for speech command. We know third parties such as Skype use encryption for video conferencing, and Samsung says it uses the same "industry standard security" for the "personal information" it transmits.?

We asked Mineola, N.Y. attorney Emouna Matin, who handles privacy cases, to explain what is meant by "personal information," and if would include video and voice samples, along with browser history and TV viewing habits.

"Samsung has to address that more properly," says Matin. Personal information can be limited pedigree information -- name, address, phone number, age, the kind of descriptive information that identifies you as an individual but doesn't say a lot about who you are -- or ?"stronger" information -- your voice, your personal images, websites visited, data that are not traditionally defined as "personal" but say a lot more about you.

Another issue is that Samsung effectively locks you into a privacy agreement before you can even use the Internet-based services of the TV. In part, this agreement reads:

We reserve the right to share all Personal Data and non-Personal Data with any company within the Samsung Electronics group of companies, or with any other company that operates under the Samsung brand. ... Each of the Samsung Group Companies will use your information in accordance with their own independent privacy practices.

The lengthy agreement goes on to say that your data will be carefully guarded and shared only when necessary "in order to pursue our legitimate interests or if we are required to or are permitted to do so by law." While this reads as relatively standard, the definition of "personal information" is, again, not made clear.

As for the "Group Companies" that can receive personal data from a Smart TV, Samsung says it is not every one of the 48 Samsung subsidiaries and joint ventures. For U.S. customers, only Samsung Electronics Co., Ltd. in Korea, Samsung Electronics America and?Samsung SDS (based in both U.S. and Germany) would share the information. For customers in other countries, their local Samsung subsidiary would also share with the Samsung Electronics Co. and SDS, which handles data globally.

It is good to see Samsung disclosing more details of its privacy policy, but the industry still has a way to go before consumers can have a complete understanding of what is at risk when using these new and unprecedented technologies. HD Guru will continue to investigate the Samsung TVs and others, in hopes of learning exactly what these new HDTV eyes and ears are sending out from your home.

Patients Are More Than A Vessel For Billing Codes

Patient as Billing Code VesselIt will be virtually impossible to succeed in the new reimbursement model without recognizing what has long been said, but little done about it -- "the most important member of the care team is the patient." Having implemented or reviewed over 100 health IT systems, there is one common purpose at the core of the architecture of these systems -- how to get as big a bill out as quickly as possible. That has been an entirely rational response to the flawed reimbursement model at the heart of healthcare's hyperinflation (here's a not-so-fun fact: Since the 60's, while all non-healthcare expenditures increased 8x, healthcare increased 274x).

Making wishes come true

MIAMI - Up to 50 Make-A-Wish kids and other children from various wish-granting agencies across the world, and their families, were treated to a private autograph signing with Sheamus, Big Show and Divas Champion Beth Phoenix Friday afternoon during WrestleMania Week.?The children enjoyed autographs, photos and a chance to meet with their favorite Superstars. (PHOTOS)

Eli, timid at first, quietly told the Divas Champion that he was looking forward to Rock vs. Cena on Sunday, as well as seeing Triple H end Undertaker's amazing WrestleMania streak. "I'm curious about the ending to that, too," The Glamazon replied with a smile on her face.

Big Show was treated to Bradley, a proud member of the Cenation, happily waving "U Can't See" to The World's Largest Athlete. The giant shared some laughs and was more than happy to take pictures.

Coming all the way from Ireland, Dylan was really excited to meet Sheamus. He even brought his Irish flag with him. "Am I allowed to sign the Irish flag?" Big Show smiled. "I'm Irish too, you know!" Dylan's mom was touched by the moment as well. "The power of a wish," she said with tears in her eyes.

Sheamus was equally excited to meet Dylan.

"Each kid is special and touched my heart in their own way," he said. "There were so many amazing kids and families." But The Great White also noted that all of the kids he met wanted him to Brogue Kick World Heavyweight Champion Daniel Bryan at WrestleMania, to which he replied, "I'm going to do everything I can to make that come through."

Big Show observed how events like this really is what WrestleMania is about. "It's about our fans and our relationship with them," an emotional Big Show said. "We give back and they give us so much in return."

Phoenix was truly touched by spending the evening with such inspirational children and families.

"It's an opportunity to give back to these great kids dealing with big problems," The Glamazon explained. "This puts it all in perspective - what's important in life. It's an honor to be a part of Make-A-Wish."

Throughout the past 25 years, WWE has granted more than 3,500 wishes (and counting) with Make-A-Wish Foundation, putting smiles on the faces of Wish children and their families.

World News - Reports: North Korea test fires short-range missiles

By Reuters

SEOUL, South Korea - North Korea fired two short-range missiles off its west coast on Thursday believed to be part of a test to upgrade capabilities, said news reports published on Friday, quoting South Korean military officials.

North Korea has raised tensions in recent weeks by announcing it would launch a rocket to put a satellite into orbit, but regional powers are urging Pyongyang to drop the plan, saying it would violate U.N. Security Council resolutions.

North Korea launched two short-range missiles believed to be surface-to-ship missiles from its west coast Thursday morning, South Korea's Chosun Ilbo newspaper quoted government officials as saying.

"The launch is believed to be to upgrade missile capabilities and not related directly to the North's long-range missile launch," the newspaper quoted a military official as saying.

Another mainstream newspaper JoongAng Ilbo published a similar report.

South Korea's office of the Joint Chiefs of Staff declined to confirm the reports, citing its policy of not speaking publicly on matters involving intelligence activities.

Reclusive North Korea has said it is merely sending a weather satellite into space, but South Korea and the United States say it is a disguised ballistic missile test.

The secretive North has twice tested a nuclear device, but experts doubt whether it yet has the ability to miniaturize an atomic bomb to fit inside a warhead.

The North has said the launch would take place between April 12 and 16. The planned launch, which has even drawn criticism from ally China, will mark the 100th birth anniversary of state founder Kim Il-sung.

CBS expands 'Face the Nation' to 1 hour on Sunday

(AP) ? Five years ago, just off a bout from cancer, Bob Schieffer was set to retire from CBS's "Face the Nation." That never stuck, and now he's doubling his workload.

Starting Sunday, the public affairs program expands to an hour. Vice President Joe Biden, whom Schieffer interviewed Thursday in Milwaukee, is the featured guest. Republican presidential candidates Newt Gingrich and Ron Paul are also booked.

With a presidential campaign under way, it's an attention-getting time for the Sunday morning shows. The landscape changed already this year when George Stephanopoulos returned to the helm of ABC's "This Week" in January.

Although the voluble Biden would seem the perfect guest for a newly expanded show, Schieffer said the move doesn't mean all interviews will be twice as long. Rather, it offers the show a better chance to react to the news, have more guests and feature CBS correspondents Norah O'Donnell and John Dickerson more.

"I don't think you're ever going to see the same kind of 'Face the Nation' twice," said Mary Hager, the show's executive producer. "We've got a lot of flexibility and we're going to take advantage of that flexibility."

Shortly after Schieffer started as host two decades ago, he said his competitor, the late Tim Russert of "Meet the Press," went to his NBC bosses to urge that the show be expanded to an hour. Give me three months, Russert said, and if the ratings don't improve we'll go back to a half-hour.

They never looked back, and Russert dominated Sunday mornings until his death in 2008.

"Tim was the best of the best," Schieffer said. "But the fact of the matter is what propelled them to No. 1 is they went to an hour and they were the first to do that. When they did that, it left us in the dust."

Schieffer repeatedly nagged his bosses to follow suit. He made the same speech when Jeff Fager and David Rhodes took over last year, not expecting much. When they gave the go-ahead, Schieffer said, "I nearly fainted."

(The approval has some strings attached. Rhodes said it will be reviewed after 20 weeks before it is made permanent.)

Ratings and election news figured in the timing. "Meet the Press," now with David Gregory, averaged 3.3 million viewers during the first three months of the year. "Face the Nation" was a close second with 3.09 million, the Nielsen company said. "This Week" had 2.53 million and "Fox News Sunday" averaged 1.15 million. "Face the Nation" is the only broadcast to see its ratings improve over last year.

Betsy Fischer, "Meet the Press" executive producer, said she's all for more Sunday morning TV time.

"When we went to an hour 20 years ago, I remember the big advantage was that it gave us much more flexibility in programming the show," Fischer said. "I suspect it will be beneficial to CBS in that respect as well."

Schieffer said he most felt the disadvantage of a half-hour slot when a guest would be booked mid-week and subsequent news would change what needed to be on the show. Schieffer said he hated to "bump" a guest off in these circumstances. Now, a person could be moved to the second half-hour.

CBS is hoping the change will improve ratings. Some rivals wonder if it might actually hurt, suggesting "Face the Nation" gets a big boost because it follows the popular "Sunday Morning" and that some of that show's viewers may leave "Face" over the course of an hour.

Schieffer, who turned 75 in February, had long planned to retire shortly after he turned 70 in 2007. He even announced it publicly. But he was persuaded to stay for the 2008 election, and retirement never happened.

"I'm just having so much fun," he said. "I don't know what I would do. My wife, who used to want me to retire, has now decided she doesn't want me to retire. She said, 'You would drive me crazy if you retire.' Now that I've got her on the team, I'm going to hang around for a while."

CM9 source code now available for the HTC Sensation

HTC Sensation

If you're rocking the HTC Sensation (a.k.a. the Pyramid for you geekier types), here's a bit of news that should interest you -- the CyanogenMod team has made the "official" CM9 repos for both the Pyramid and the MSM8660 chipset common files available and open to the public. There's no official release candidate for the Sensation just yet, as there are a few kernel bugs the team wants to iron out before releasing an official CM build, but this means that your favorite ROM developer now has access to what many feel is the cream-of-the-crop in third party Android development -- CM sources.

We've seen ICS builds leak for the the Pyramid, and these no doubt helped push along the development. But if you've been waiting for a Sense-free build of Android 4.0 for your Sensation, the end is in sight. Keep an eye on your favorite developer, and get ready to start flashing.

bizmatcenter.org ? Kids and Teens Encounter A lot of Issues in the ...

Write-up by Saira

What?s it like to be a kid these days with all the difficulties that experience them when contemplating their foreseeable future? When kids are in their pre-teenager ages, this is not a thing that typically worries them, but it does concern moms and dads. Every stage in life sets oneself up for the next stage, so it is essential for young children to have a strong groundwork with every single action they take in life. A neglected kid as a child doesn?t stand a lot of a opportunity to grow in a good course. Possessing constructive influences in their lives for the duration of the years ahead of school will set a great basis once they phase foot within their very first classroom where they will begin to kind their bonds with other young children who are also commencing their trek in the direction of adulthood. Considering about adulthood at this age would seem a little bit premature, but if a mum or dad requires their youngsters potential significantly, their likelihood of success is considerably higher. This is not declaring that children need to increase up more rapidly and not be children, simply because that is as crucial, if not much more essential. What is important is to allow a child to mature commonly, whilst recognizing that each section in their life is portion of what molds them into the grown ups we meet nowadays. As well a lot of children are allowed to be the ?boss? in their homes. Kids require structure and discipline, and when appropriately orchestrated, daily life will be less difficult for Kids And Teens each the kids and the parents. Instructing a child to be robust and impartial will help them to deflect from the peer pressures that will definitely arrive in the years to follow. As soon as a pre-teenager becomes a teenager, what they have been taught in prior several years will truly check their power. Higher university starts the last foundation to adulthood, and with the correct assistance, it can be a positive one particular. With high university, will come the concern of boys and girls exploring their emotions and forming relationships. We can not rely on that the other individual has equivalent principals as our very own youngsters, and all we can hope for is we did a good task instilling great values, morals and principals in our youngsters to make the correct selections. If peer stress gets to be way too significantly, a teenager who arrives to their moms and dads for guidance is a kid who was raised properly to have confidence in in their mother and father to aid them through this without having the dread of being in difficulty. Kids and teens are delicate and need to be molded in steps. For every stage is transferring in the direction of the up coming action. If a single stage is off, it could head them in the inappropriate route. We can never ever promise that each selection kids and teens make will be the right 1, but with the suitable groundwork set for them at residence, the better their chances will be to shift them towards as productive long term.

Online Video Market Revenues Seen to Grow Fourfold in 2020 ...

ACCORDING to latest studies on the ever-evolving internet industry, profits from the online video market are seen to grow four-fold by 2020.

Advertisers and marketers in the United Kingdom?s television and broadcast business were surveyed by MTM on how they view the online market in the next 8 years.

More than 77 percent, or three-quarters, expect solid growth in revenues and are optimistic about their overall financial performance.

Presented at the Guardian Changing Media Summit, the results also showed that businesses predict revenues from online ads to grow more than 300 percent by 2020.

On top of this, a study conducted by the Red Bee Media revealed that nearly 60 percent of respondents forecast brand placement advertising-funded programs to emerge as a very important source of profits.

Chief executive officer Bill Patricio said that if the last decade has witnessed the convergence of broadcast networks with broadband, it is possible that the remnants of the coming years will experience a rivalry between changing patterns of consumption and business models steered by consumer demand.

The study also found that more than 70 percent of the respondents are certain that the competition for quality online video content will rise intensely in the coming years.

Patricio emphasized that online media firms will need to put up a good fight and find more innovative ways in the rapidly changing online landscape if they are to take advantage of the market and succeed.

Online empires like YouTube and Google may be among the firms that have the most chance of benefiting in the online video war.

Based on a separate review conducted by eMarketer, online video advertising will have a bigger share of web marketing spending.

The firm predicts the medium to double its revenue share in ad spending to 16 percent in 2016. Online video remains to be the fastest growing advertising format on the internet, with budget allocation increasing by over 50 percent this year.

Meanwhile, a scarcity of quality ads inventory will be the main challenge for online video, but the issue can be easily resolved, if not turned into a benefit.

This was the viewpoint of Video Hub general manager Anthony Risicato, who was special guest during the Bee.TV Executive Forum in Vieques this week.

Risicato said that while online video inventory for premium and quality online ads is limited, television is hounded with the same problem and has turned the issue into an advantage.

Report: Windows 8 beats Windows 7 in most performance tests

While there is a lot of debate about the Metro user interface that Microsoft has created for Windows 8, it seems that in terms of sheer performance, the new version of the Windows OS is better overall than the current version, Windows 7.

That's the conclusion of a new report on PCWorld.com. Its PCWorld Labs division recently ran a number of tests on the Windows 8 Consumer Preview. It included a test using its own proprietary benchmark software WorldBench 7.

Both Windows 8 and Windows 7 were installed on a PC with the same hardware specifications. It included an 3.3 GHz Intel Core i5-2500K processor with 8 GB of DDR3 RAM, a 1 TB hard drive, and an Nvidia GeForce GTX 560 Ti graphics card.

The WorldBench 7 benchmark results showed that the Windows 8 Consumer Preview was 14 percent faster than Windows 7. Other tests such as startup time, web performance and content creation all showed the pre-release version of Windows 8 performing better than Windows 7.

One test, the office productivity benchmark, did show Windows 7 beating Windows 8 Consumer Preview by eight percent. The article notes that Microsoft likely will improve performance in upcoming pre-release versions of Windows 8 before it is officially launched later this year.

International Business Team Places Fifth in Netherlands ? Belmont ...

Belmont University business students placed fifth during the 2012 Network of International Business Schools (NIBS) Worldwide Case competition in Rotterdam, Netherlands.

College of Business Administration students Ayesha Ghaffar, Rami Nofal, Jordan Holt and Shirah Foy competed at the Kralingse Zoom in Rotterdam from Feb. 26 to March 2. Teams from across the world submitted case solutions for review, and the top 10 teams?were selected to face off at NIBS final competition.

?Once again our students have made us extremely proud,? said Assistant Professor of Economics Marieta Velikova, who accompanied the students to the Netherlands. ?They were truly amazing. Presentation, analysis, idea, alternatives assessment, financials, implementation, contingency plan, Q&A ? I could not have asked more, or they could not have done better.?

Each team had four hours to prepare a case without outside help. Their presentations were assessed by a jury of professional and academic experts. The cases were about a Lebanese social enterprise company, a South African company automotive manufacturer, social media marketing in China and the bio tech industry.

??I think really the group we made was unique ? knowing the quantitative side of business, having the ability to synthesize information and knowing a creative marketing. Each of us had our own backgrounds and area of expertise. It was a blend of academics, theoretical frame work and being involved on campus that engineered the team,? said Rami Nofal, a junior from Nashville studying international business, finance and economics.

?Going into the NIBS competition as the new team this year, we came with great attitudes and hard work ethic, but weren?t provided much specific information about how to best prepare for the presentations. The learning curve was incredibly steep, and after losing the first round to some of the best presenters there, we spent the rest of the night reorganizing and putting together a strategy for the next few days of presentations,? said Foy. ?(We) truly came together to capitalize on our strengths in formulating solutions for the cases and translating these ideas into a cohesive presentation. ?But we could not have done it without the constant encouragement and spot-on guidance from our wonderful coach.?

Belmont was the only team that won both its morning and afternoon cases on Feb. 28. In the history of NIBS case competition, the newcomer team has never won more than one case.

The students won cases against the?International Business Academy from Denmark, Carleton and Salisbury University. Despite a sick presenter, technical difficulties and facing another team with wardrobes sponsored by a local fashion store, Belmont went on to beat the 2011 NIBS winner Memorial University .

?The judges said that it was the best case solution and presentation they have watched since (the beginning of this year?s competition). They were so complimentary to our team. One?judge even after the formal feedback found us and shook our hands and spoke so complimentary to our team members. She told them that she was very impressed with their knowledge and ability to think and understand complex business problems,? Velikova said. ?This competition has just once again reminded me that what we do every day in the classroom matters and has such a long lasting impact. Being here and listening to our students present made me so proud of our students, program, and of course faculty.?

Overall, Belmont placed ahead of Salisbury University, International Business Academy of Denmark, KHLeuven, Memorial University and Rotterdam University of Applied Science; however, the four teams with the highest scores advanced to the semifinal round.

?Participation in the NIBS competition and the ultimate success of the Belmont team is evidence not only of our continuing mission to internationalize the College of Business but also of the exceptional quality of our students,? said Jeffrey W. Overby, associate professor of marketing and director of the Center for International Business.

This was the second international business case competition for Belmont students this school year.? Ghaffar, Holt and Nofal, along with Patrick Hurt, brought home several awards from the Eighth Annual Center for International Business Education and Research Case Challenge in October.

Mali soldiers attack palace in coup bid

BAMAKO (Reuters) - Mutineering soldiers attacked Mali's presidential palace overnight on Thursday as a protest over the government's handling of a nomad-led rebellion in the north turned into an all-out attempted coup.

Sporadic heavy weapons and tracer fire rang out around the capital Bamako through the night and the mutineers, who say they lack arms and resources to face a separatist insurgency in the Sahara, temporarily forced the state broadcaster off air.

"We now know it is a coup d'etat that they are attempting," a defense ministry official said, asking not to be named.

The official said President Amadou Toumani Toure, who has long said he will relinquish power after elections scheduled next month, was in a secure location but gave no more details.

U.N. Secretary-General Ban Ki-moon called in a statement for calm and for grievances to be settled democratically.

Programs on state television were interrupted after the mutinous soldiers blocked access routes to it. It was not clear to what extent they were in control of the building when it came back on air late on Wednesday.

"In a moment, there will be a statement by the military," read a brief message, displayed against a backdrop of traditional Malian music and dance.

Anger has grown in the army at the handling of a Tuareg-led rebellion that has killed dozens, forced some 200,000 civilians to flee their homes and exposed Bamako's lack of control over the northern half of a country twice the size of France.

In a sign of spreading support for the mutiny, two military sources in the northern town of Gao confirmed the arrests of several senior officers in the town, a regional operations centre.

WIDER FRUSTRATIONS

Soldiers have for weeks appealed to the government for better weapons to fight the rebels, who are bolstered by fighters who had fought in Libya's civil war last year. But many mutineers said they now wanted to oust Toure himself.

"He needs to leave power, that is all. The movement will only stop with the taking of the palace," said one sergeant, who asked not to be named. Other soldiers toured Bamako shouting anti-Toure slogans.

There was no word from Mali's presidency. Statements posted by its official Twitter handle earlier in the day said there was no coup attempt.

"These people are tapping into frustrations of the population," said one Bamako-based diplomat of the mutiny. Bamako residents reported cases of the military requisitioning vehicles in the streets.

Bamako was briefly paralyzed last month as hundreds of Malians put up street barricades and burned tires in the streets to protest at the government's handling of the rebellion.

The situation in Mali was raised during consultations at the U.N. Security Council on Wednesday, British U.N. Ambassador Mark Lyall Grant said, adding that Council members appealed for calm and "respect for the constitutional order".

Toure, in power since 2002, has said he is planning after April elections to hand over the reins of a country known for its gold, cotton and a once-flourishing desert tourist industry now undermined by a spate of hostage-takings by al Qaeda allies.

The former paratroop commander overthrew a dictatorship in a 1991 coup and relinquished power a year later before returning to office via the ballot box.

A military source said a trigger for Wednesday's events was a visit by the defense minister to a barracks in the town of Kati about 20 km (13 miles) north of Bamako.

"The minister went to speak to troops but the talks went badly and people were complaining about the handling of the crisis in the north," the source said.

A defense ministry official who was at the meeting said a soldier accused the defense minister of betraying them by not giving them means to fight the rebels. Soldiers then began throwing rocks at the minister before taking weapons from the armory and shooting in the air.

Tuareg fighters seeking to carve out a desert homeland in Mali's north have made advances in recent weeks, including the seizure this month of the key garrison town of Tessalit by the Algerian border.

The MNLA rebel movement has been bolstered by heavily armed Malian Tuareg returning from fighting with Libyan forces who tried in vain to prevent Muammar Gaddafi's overthrow last year.

The clashes have added a new layer of insecurity to a zone awash with smugglers and plagued by fighters linked to al Qaeda and is expected to complicate presidential elections in April.

Boeing's SUGAR Freeze is a cool way to power a plane

Image
No, not the sensation you get when you have gulped your ice cream too fast. SUGAR Freeze is the a new propulsion concept developed by Boeing that aims to revolutionize air travel. Standing for Subsonic Ultra Green Aircraft Research, the NASA-commissioned project (codenamed "N+4") looks at immature technologies in the hope of kickstarting research for the future. It's reportedly 60 percent more efficient than the equivalent Boeing 737-800, thanks to a very experimental propulsion system. Cryogenically stored liquified natural gas (hence "Freeze") is burned in a pair of unducted fan engines while also powering a solid-oxide fuel cell as an aft-thruster. With LNG projected to remain abundant, more environmentally friendly and cheap well into the century, it makes an ideal substitute to current aviation fuel, which is none of those things. Currently it's far too unsafe a design to contemplate building, and there are concerns about methane in the natural gas production process, but hopes remain that the kinks will be ironed out well before the 2045 deadline.

  1. i was pulled over the eighth of march in the 12th year of the 21st century, not knowing my license was suspended. now with that being said, i live in Alaska. when confronting the courthouse and the judge here would it be safest not to enter a plea and state that i was unaware of the suspension of my license? i feel that i harmed no one, the complaint was not civil, i was not cited by a citizen, but a police officer for the status of my passenger being unbuckled. at that point i was informed my license was suspended in the state of Arizona. i feel that any charges presented to myself should be dismissed due to the fact that i was unaware.

You must have done something irresponsible in AZ to warrant a license suspension. Ignorance of the law is not a defense. In fact, it sounds like you moved to Alaska to avoid the problem.

Disagreeable is right in that ignorance of the law is not an excuse. You can't use the defense of not knowing your license was suspended in court, they will just laugh at you. You can plead guilty and pay the fine, or hire an attorney and attempt to fight the charges or at least get some type of better plea deal.

Why Businesses, Non Profits and Govt Need Background Checks ...

Last week, I attended the Due Diligence, Background Checks and Employment Conference at the U.S. Chamber of Commerce in Washington D.C.? This one day symposium featured presenters and panelists that spoke directly about the need for employers to conduct criminal background checks and the role they play in protecting their employees, their customers and their businesses.? Today, I wanted to highlight the panel discussion, ?Why Businesses, Non-Profit Agencies and Government Entities Need Access to Criminal Background Checks?.

The panel was comprised of the following individuals: Jim Hmorovich, President and CEO of Prevent Child Abuse America (PCAA), Richard Mellor, Vice President of Loss Prevention at the National Retail Federation (NRF) and Donald Livingston, Partner at Akin Gump and former General Counsel at the EEOC.

Richard Mellor, former head of security at Helzberg Diamonds, spoke about the important role criminal background checks play in protecting businesses, co-workers and customers.? He spoke of some of the horrible things he has seen employees do over the course of his career including murder, rape, armed robbery, and too many thefts to count as well as the fact that U.S. businesses lose billions of dollars each year to internal theft.

However, he also spoke about the proper balance between protecting the business and ensuring everyone has a fair chance at employment.? He highlighted the standards employers are held to under the Fair Credit Reporting Act and also the fact that the presence of a conviction is not an automatic trigger to eliminate the candidate from consideration or terminate an existing employee.

Donald Livingston also discussed the imperative employers have to screen and provided an in-depth analysis of an employer?s compliance responsibilities to ensure fair treatment. Citing U.S. Office of Personnel Management (OPM) standards, he pointed out that the Federal government often requires extensive background checks for a wide range of positions. He questioned why the Federal government is being afforded protection for use of credit and other sources of information that are being denied to private employers .

And while both Mellor and Livingston did a masterful job of making their cases, the most impactful speaker was PCAA?s Jim Hmorovich.? Jim provided statistics on the number of children that are abused in this country and the rates are alarming.? Obviously, he advocates for the necessity to conduct background checks in order to protect children.? But Jim?s perspective on the issue wasn?t just to protect children now, but to ensure that they become productive members of society.? Jim offered that children who are abused are far more likely to turn to a life of crime themselves (whether they become abusers, addicts or otherwise).

He also made the case that if someone wasn?t swayed by the emotional arguments, then perhaps they?d consider the fiscal benefits.? If children aren?t abused, they have a much better chance of getting educated, of finding jobs and not engaging in criminal activity.? That means less people on welfare, less people in our prison system and less victims. It means more people prepared to enter the workforce, to pay taxes and contribute to society in a positive way.? It?s also has the added benefit of reducing unemployment.

Overall, I found this panel to be highly effective because they addressed a wide perspective on why criminal background checks are vitally important not only for employers but for society in general.

Stars create gaps devoid of gas giants, study finds

Computer simulations of young solar systems suggest that gas giants seem to avoid certain orbital regions around stars, a phenomenon caused by intense radiation emanating from young stars.?

Gas?giants, that is, planets like Jupiter and Saturn, tend not to orbit their star at just any old spot. Instead, they?tend to prefer certain regions while staying clear of others.?

Now, a new study reveals that these orbital "pile-ups" and "deserts" are actually caused by starlight itself.?

Using computer simulations of young solar systems, astronomers?Richard Alexander of the University of Leicester in the United Kingdom and?Ilaria Pascucci of the University of Arizona's Lunar and Planetary Laboratory have found that powerful ultraviolet and X-ray emissions from the star tend to carve out empty spaces.?

Planetary systems begin as a spinning disk of dust and gas particles, some of which eventually clump together by gravity to form planets, moons, asteroids, comets, and other bodies. ?

"The disk material that is very close to the star is very hot, but it is held in place by the star's strong gravity," said?Alexander in a press release from the University of Arizona. "Further out in the disk where gravity is much weaker, the heated gas evaporates into space."

Around a star like our sun, these gaps ? where the gas has evaporated ? appear about 100 million to 200 million miles from the star.

"The planets either stop right before or behind the gap, creating a pile-up," said?Pascucci in the press release. "The local concentration of planets leaves behind regions elsewhere in the disk that are devoid of any planets. This uneven distribution is exactly what we see in many newly discovered solar systems."?

Oddly enough, this does not seem to occur in our own solar system. Earth orbits the sun at an average distance of about 93 million miles, which is about where a gap should occur. Jupiter, the gas giant closest to our sun, orbits at a distance of about 500 million miles.?

Time will tell if?Alexander and?Pascucci's model is correct. As the Kepler space telescope detects more planets, we should expect to see pileups of gas giants at about 100 million to 200 million miles from their sun.?

Alexander and?Pascucci's study appears in the?journal Monthly Notices of the Royal Astronomical Society.
